Magic Parti Poodles
extends the following warranties to the buyer named on the
registration papers and begins the moment the buyer takes possession
of the puppy.
The LIMITED WARRANTIES COVER YOUR PUPPY ONLY.
We are not responsible for any associated charges such as
veterinarian fees.
To qualify for these limited warranties, you must have your
puppy examined by a licensed veterinarian of your choice within
3 business days of purchase.
LIMITED 72-HOUR WARRANTY ON HEALTH:
We guarantee against congenital defects such as heart, lung,
kidney and other life threatening congenital defects found
during the initial exam. Seller is not responsible for
accidents or injuries during and after shipping or
delivery and no warranty will be honored. We warranty
against health issues only.
You must request a written statement from your Vet on his office
stationery signed and dated by him/her, for our records, stating
the health risk to include a description of the symptoms,
supporting his/her opinion to validate the guarantee.
To make a claim for a replacement puppy, you must notify us by
telephone the day of the initial exam. Then submit the paper
documents from your veterinarian and statement in writing and
return the puppy - see terms of replacement below. (No Cash Refunds)
GENERAL TERMS & CONDITIONS
If buyer's puppy qualifies for a replacement, they can choose a
new puppy with a retail price value equal to or less than that
of the original puppy, when one becomes available provided that
this puppy is not on hold or sold waiting to go home.
If buyer chooses a replacement puppy that has a retail value
greater than the original puppy, buyer is responsible for the
difference in cost.
If Magic Parti Poodles does not, within 1 year, offer you a
replacement puppy of the same breed, sex and retail value as
your original puppy, then you will be entitled to a Cash Refund
of your puppy's original purchase price minus the non refundable
deposit and shipping cost. (the reason that the term is for 1
year is that we don't breed our dams every time they are in
heat, therefore it may be awhile before we have available
puppies.) This applies to puppies within the 72 hour
warranty period.
NOTE: This is the only circumstance in which a cash
refund will be issued under the limited warranty.
Buyer qualifies for a replacement puppy only for the reasons
stated herein.
Seller makes no warranty that the buyer will be able to show or
breed the puppy.
Seller makes no warranty on the size, color, fertility or
descent of testicles upon maturity.
If buyer wishes to make a claim, a copy of this warranty must be
presented when puppy is returned.
When a puppy is returned under this limited warranty, buyer must
return and sign all paperwork to seller. In other words
Registrations and all other pertinent documentation will be
signed over to the seller when the puppy is returned.
Seller is not responsible for any payments for exams, drugs,
x-rays, or other treatments.
Seller is
not responsible for
travel or shipping expense incurred in return or
treatment of the puppy or in shipping the replacement puppy.
Seller does not guarantee against parvo or corona virus after 72
hours of purchase.
This guarantee is non-transferable and applies ONLY to the
original buyer.
The dog must be in good physical condition.
No replacement will be given if the female has been bred.
No replacement if the registration application form has expired.
All laboratory verification must be done by a licensed
veterinarian.
The owner is responsible for transportation costs to and from
the seller.
Seller is not responsible for any and all veterinarian expenses
accumulated on returned or replaced dog or puppy.
Seller's
poodles are for companion purposes only.
AGAIN ..
Seller is not responsible for any genetic problems concerning
breeding. No guarantees apply to females who are sterile,
fail to come into heat or die during the whelping process.
No guarantees further apply to males that are infertile or
testicles do not descend.
This written statement sets the terms between the seller and the
buyer of this puppy. Upon delivery, the buyer agrees to the terms
and conditions upon receipt of this puppy and shall be considered
agreed upon by the buyer, and shall considered the same as the
signature by the buyer that the buyer agrees to these terms by
taking possession of the puppy.
Should you find
that you cannot keep this dog in the future, for whatever reason ... rather than
choosing
abandonment or abuse please call us. We will take the dog back
(no cash back) and try to
find him/her a good home. Transportation is not the
responsibility of the breeder but the dog owner who is relinquishing
ownership of the dog. Papers will be signed to transfer
ownership back to us and an agreement will be signed as to avoid any
confusion or misunderstanding about the ownership of the dog.
